UNDT/2020/126, Pierre

UNAT Held or UNDT Pronouncements

The Tribunal found the Respondent’s explanation for extending the Applicant’s FTA for one month plausible. It thus held that the impugned decision was not unlawful.

Decision Contested or Judgment/Order Appealed

The Applicant contested MINUSMA’s decision to extend his fixed-term appointment (FTA) for one month until 31 July 2019.

Legal Principle(s)

Pursuant to staff regulation 4.5, a fixed-term appointment does not carry an expectancy of renewal. However, according to the Tribunal’s jurisprudence, discretionary decisions regarding renewal of appoitments are subject to evaluation for reasonableness, lack of arbitrariness or improper purpose.
