UNAT held that UNDT was correct to find that the application was not receivable. UNAT dismissed the appeal and affirmed the UNDT judgment.
The Applicant contested the lack of response on the issue of allowing her to pay UNJSPF contributions retroactively following a period of special leave without pay. UNDT held that the application was not receivable ratione materiae on the basis that the Applicant had failed to request management evaluation within 60 days from the notification of the contested administrative decision.
Time limits in the context of the UN internal justice system must be observed and strictly enforced. It is incumbent on UNDT to individualize and define the administrative decision challenged by a party and to identify the subject of judicial review.
