Receivability: For an application to be receivable, it must clearly identify the contested decision and be preceded by a request for management evaluation, where management evaluation is required.
The Applicant, a former ICTY staff member, filed with the Tribunal a submission entitled “Motion to act to ethnic discrimination at the ICTY led by the ICTY CLSS Management and former ICTY Registrar …”. The UNDT Registry acknowledged receipt of the Applicant’s motion and requested him to complete and file the relevant application form, drawing his particular attention to the sections concerning identification of the contested decision and management evaluation. Though maintaining his claim of discrimination, the Applicant failed to complete the relevant form and to identify the contested decision. Having determined that summary judgment was appropriate, the Tribunal declared the application irreceivable.
